FACTS

The Appellant was tried and charged for:

1. Allegedly poisoning Mr George Chabe in January 2000, with a green chemical poisonous substance known as "malachite green". This substance is said to be toxic to human beings and fatal if ingested. Mr Douglas Simon was charged together with Mr Maokaneng Mokolong (traditional doctor) who is said to have provided Mr Simon with the poison. Mr Chabe, the deceased, was a previous employee of Mr Simon, who (Mr Simon claimed) had stolen P24,000 from him.

Mr Mokolong was acquitted by the Court of Appeal.
