PRESS STATEMENT ON PROPOSED CONSTITUTIONAL AMENDMENT OCTOBER 2003
CONSTITUTIONAL AMENDMENT FOR TRIBAL NEUTRALITY

DITSHWANELO - The Botswana Centre for Human Rights seeks to congratulate His Excellency President Mogae for his announcement that amendments to sections 77, 78 and 79 of the Constitution of Botswana will be submitted to Parliament, to make the Constitution tribally neutral.  This was said in his Independence Day Message to the Nation, 30 September 2003.

It is indeed encouraging that the Government has decided to take heed of the concerns raised by civil society. There is no place in a functioning democracy, for discriminatory legislation, policies and/or practices. It is however necessary that any reform of law, should be comprehensive within a human rights framework. Legislation, which should be reviewed, includes The Chieftainship Act, the Tribal Territories Act and the Tribal Land Act.

Following the recent successful Vision Awareness Week, such review can only contribute towards the realisation of Vision 2016. To achieve the United and Proud Nation based on the diversity of 'cultures, languages, traditions and peoples sharing a common destiny', requires a commitment of accountability and mutual respect on the part of all citizens. The Government, as a major player needs to provide leadership on the tolerance of diverse opinions. As President Mogae stated, 'The strength and success of our nation depends on our ability to appreciate and manage our differences.'

DITSHWANELO will continue to advocate for the rights and responsibilities of the marginalised and disempowered, in order for their voices to be heard. Recognition of the inherent strength which lies in the diversity of opinions, cultures, languages, traditions and peoples, is indeed a laudable essential requirement for sustainable development and democracy.
